Membership and Distance Sales Agreement

This Membership and Distance Sales Agreement ("Agreement") has been concluded electronically between AppHurra Bilişim Teknolojileri Anonim Şirketi ("AppHurra"), which operates the AppHurra platform, and the user ("User") who is a member of the platform and/or creates an event registration through the platform.

 

By becoming a member of the platform or benefiting from the services, the user declares that he/she has read, understood and accepted all the provisions of this agreement.

 

1. Parties

A natural or legal person who is a member of the platform or registers for an event.

 

2. Subject of the Agreement

The subject of this contract;

  • User's membership to the AppHurra platform,
  • Registering for events through the platform,
  • Providing paid or free event services,
  • Sales transactions carried out electronically,
  • It is the determination of the rights and obligations of the parties.

 

3. Service Description

AppHurra;

  • running,
  • trail running,
  • swimming,
  • bicycle,
  • outdoor sports,
  • social events,
  • Seminars and Organizations

It is a platform that provides digital registration and payment infrastructure for various events, especially the S.

AppHurra may not be the event organizer. Many events are organized by third-party organizers. AppHurra can provide registration and payment infrastructure on behalf of the relevant organization.

 

4. Membership Conditions

  • The User agrees that the information provided during registration is accurate and up-to-date.
  • Users under the age of 18 must trade with the consent of a legal representative.
  • The security of the user account is the responsibility of the user.
  • The user agrees to use the platform in accordance with the law and good faith.
  • In case of creating a fake account or providing misleading information, membership may be suspended or terminated.

 

5. Event Registrations and Sales Transactions

The user can register for paid or free events through the platform.

For paid events:

  • Event fee,
  • Service fee,
  • The Commission,
  • Taxes

It can also be shown on the checkout screen.

After the payment process is completed, an electronic record is created on behalf of the user.

Some events may have capacity limitations. When the quota is full, the registration process may close.

 

6. Distance Sales Information

This contract is a distance sales contract within the scope of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

The User acknowledges that he has been informed of the following:

  • Basic characteristics of the purchased service,
  • Total sales price,
  • Payment method,
  • Cancellation/refund conditions,
  • Organization rules,
  • Service provider information,
  • Exceptions to the right of withdrawal.

 

7. Right of Withdrawal and Refund Policy

Event recordings submitted within the scope of entertainment, sports and leisure activities that must be carried out on a certain date or period may be outside the scope of the right of withdrawal in accordance with the Distance Contracts Regulation.

When the user creates an event record, the event is:

  • cancellation,
  • Return,
  • transfer,
  • Category change

It is obliged to examine the conditions separately.

Unless otherwise specified by the organizer:

  • No refunds may be made for completed registrations,
  • service fees and commissions may not be refunded,
  • If race kits have been delivered, the return may be rejected.

If the event is canceled by the organizer, the refund conditions can be determined by the organizer.

If AppHurra is only the infrastructure provider, it cannot be held directly responsible for the organizer's decisions.

 

8. Organizational Responsibility

The relevant organizer is responsible for the content, track, safety, race rules, awards, health measures and operational processes of the events.

User:

  • His/her own health condition is suitable for sports activities,
  • has the necessary physical competence,
  • that he accepts the sporting risks that may occur

AppHurra;

  • weather conditions,
  • force majeure,
  • organizer decisions,
  • public authority transactions,
  • Technical glitches

cannot be held responsible for any changes that may occur due to this.

 

9. User Content

User uploaded:

  • photo,
  • comment,
  • Result sharing,
  • Visual content

must not be unlawful.

AppHurra;

  • inappropriate,
  • misleading,
  • constitutes a violation of rights,
  • Offensive

has the right to remove content.

The user accepts that he/she has the right to use the content he/she uploads.

 

10. Protection of Personal Data

The personal data of the user is processed in accordance with the KVKK and relevant legislation.

The user agrees that his/her information may be shared with the relevant organizers if he/she registers for the event.

11. Intellectual Property Rights

On the platform:

  • logo,
  • visuals,
  • brand,

It is owned by AppHurra or their respective rights holders.

Unauthorized use, reproduction, or distribution may not be made.

 

12. Account Suspension and Termination

AppHurra may suspend or terminate a user account in the following cases:

  • Use in violation of the contract,
  • Suspicion of forgery,
  • Unlawful transaction,
  • Behaviors that threaten system security,
  • Actions that violate the rights of other users.

 

13. Limitation of Liability

AppHurra;

  • from third-party organizer services,
  • internet outages,
  • problems arising from the bank or payment institution,
  • problems caused by user devices

is not responsible.

The platform does not guarantee uninterrupted or error-free operation.

 

14. Dispute Resolution

In disputes that may arise from this agreement, the laws of the Republic of Turkey are applied.

In disputes, the user must have the following information about the place of residence or the location of the AppHurra headquarters:

  • Consumer Arbitration Committees,
  • Consumer Courts

15. Enforcement

By becoming a member of the platform or registering for an event, the user is deemed to have accepted all the provisions of this agreement.

This Information Text has been prepared by AppHurra Bilişim Teknolojileri Anonim Şirketi (“AppHurra” or “the Company”), which operates the AppHurra platform, to inform users about the processing of personal data within the scope of the Law No. 6698 on the Protection of Personal Data (“KVKK”).

Execution of event registration processes
Execution of ticketing and payment processes
Creation and publication of race and event results
Communication with participants
Making event announcements and notifications
Technical support and improvement of user experience
Fulfillment of legal obligations
Prevention of fraud and abuse
Statistical analysis and reporting

4. Transfer of Personal Data
Your personal data may be shared with the following parties in accordance with Articles 8 and 9 of the KVKK (Personal Data Protection Law):

Organizer companies and clubs that organize the event
Race timing and results service providers
Payment institutions and banks
Legally authorized public institutions and organizations
Business partners from whom technical infrastructure, hosting, software and support services are obtained
Sponsors and business partners (only within the scope of explicit consent)

If you register for an event; your name, surname, contact information, category information, team/club information, emergency information, race performance data and additional information necessary for event registrations (t-shirt size, shoe preference, performance data, etc. information included in the event registration form) may be shared with the organizer of the relevant event. This sharing is necessary for the smooth running of the event, participant management, concluding, awarding and security processes.

In addition, race results, ranking information, bib number, team name and similar performance data may be published publicly.

5. Method and Legal Basis for Personal Data Collection
Your personal data is collected electronically through:

Website membership and registration forms,
Mobile applications,
Payment screens,
Cookies and digital tracking technologies,
Email and contact forms,
Organization application processes.

Your data is processed based on the following legal grounds:

Establishment or performance of a contract,
Fulfillment of legal obligations,

Establishment, exercise or protection of a right.

6. Your Rights Under the Personal Data Protection Law (KVKK)
Under Article 11 of the KVKK, you have the following rights:
